Demand Letter dated 12-6-24 to the Association

On December 6, 2024—just 15 days after the Board was elected on November 21, 2024, and before a single meeting was held or any policy changes were made—a group of owners hired legal counsel to send a seven-page demand letter to the Association. Among those behind the letter was former Board member Jorge Castillo, who had just lost in the election.

Application is no longer available.

On May 24, 2025, the plaintiffs escalated their campaign by filing a lawsuit against the Association. This lawsuit is built on misrepresentations and false allegations, continuing the same pattern of behavior that began with their demand letter in December 2024

7/24/25 CBS News runs a story  about 30 owners suing the board

Using pictures taken before the current Board was even elected, former Board member Jorge Castillo appeared on CBS News, choosing to hide his face while spreading false claims. By doing so, he advanced his personal agenda and continued his effort to attack our homes, our community, and the reputation of Brickell on the River South.

On July 31, 2025, the Association’s attorney filed a Motion to Dismiss in response to the plaintiffs’ lawsuit. This filing underscores the lack of merit in the claims being brought forward and demonstrates that the lawsuit is both baseless and frivolous.

On August 25, 2025, the plaintiffs filed an Amended Lawsuit, doubling down on their misinformation campaign. Instead of correcting the baseless claims already challenged in court, the amended filing was filled with even more misrepresentations and false allegations. This pattern demonstrates a clear attempt to distort the facts, mislead the community, and prolong costly legal proceedings — all at the expense of every owner at Brickell on the River South.

Once again, using pictures taken before the current Board was even elected, Carolina Sánchez-Hervas appeared on the news to push a false narrative. By spreading these misrepresentations, she furthered the plaintiffs’ agenda and attempted to damage both our community’s reputation and the value of our homes at Brickell on the River South.
